Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and Organize KAOS, LLC (“Organize KAOS,” “we,” “our,” or “us”), governing your access to and use of our website and all current and future products, services, Digital Products, coaching services, memberships, subscriptions, events, communications, and other offerings provided by Organize KAOS (collectively, the “Offerings”).

Please read these Terms carefully before accessing our website or purchasing any Offering.

By accessing or using our website, creating an account, purchasing an Offering, downloading Digital Products, participating in coaching or other services, subscribing to communications, or otherwise interacting with Organize KAOS, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and any additional agreements or policies applicable to a specific Offering.

If you do not agree to these Terms, you are not authorized to access or use our website or any Organize KAOS Offerings.

1. Eligibility

By accessing or using our website or any Offering, you represent and warrant that you have the legal capacity to enter into a binding agreement under the laws applicable to your jurisdiction.

If you access our website or purchase an Offering on behalf of a business or other legal entity, you further represent and warrant that you have the authority to bind that entity to these Terms.

Organize KAOS Offerings are intended only for individuals and entities legally permitted to enter into enforceable agreements. Any use that violates applicable law or these Terms is prohibited.

2. Offerings

Organize KAOS Offerings include, but are not limited to, Digital Products, printable resources, books, coaching services, consulting, speaking engagements, workshops, memberships, subscriptions, courses, certifications, physical products, organizing tools, merchandise, licensing opportunities, and other current or future offerings provided by Organize KAOS.

Information about our Offerings may include descriptions, illustrations, demonstrations, pricing, availability, specifications, examples, photographs, videos, or other informational Content. While Organize KAOS makes reasonable efforts to maintain accurate information, we do not warrant that all information will always be complete, current, accurate, or error-free.

Offerings, features, pricing, promotions, and related Content may be modified, improved, replaced, discontinued, limited, or removed at any time without prior notice.

Nothing in these Terms obligates Organize KAOS to continue any Offering, feature, pricing, or promotion.

3. Digital Product License & Permitted Use

Unless otherwise stated in a separate written agreement, obtaining a Digital Product grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use that Digital Product solely for your personal, non-commercial use.

Obtaining a Digital Product grants you the right to use that Digital Product. It does not transfer ownership of the Digital Product, the underlying Content, or any intellectual property rights belonging to Organize KAOS.

Unless expressly authorized in writing by Organize KAOS or otherwise permitted by applicable law, you may not copy, reproduce, distribute, publish, sell, lease, rent, sublicense, assign, modify, create derivative works from, translate, publicly display, publicly perform, reverse engineer, share, or otherwise exploit any Digital Product or related Content.

You may not upload, store, distribute, or otherwise make any Digital Product or related Content available through websites, shared drives, file-sharing services, online marketplaces, artificial intelligence platforms, or any other system where it may be accessed by individuals other than the licensed User.

Unless otherwise stated in writing, each Digital Product is licensed to one User. Classroom, organizational, business, commercial, or other multi-user use requires a separate written license from Organize KAOS.

Any unauthorized use automatically terminates the license granted under these Terms without limiting any other rights or remedies available to Organize KAOS.

4. Intellectual Property

All Content made available by Organize KAOS, whether existing now or developed in the future, is protected by applicable intellectual property laws and remains the exclusive property of Organize KAOS or its licensors.

Content includes, but is not limited to, the KAOS Method, the NEW Decision Filter, organizing frameworks, methodologies, educational materials, Digital Products, written works, graphics, illustrations, artwork, photographs, videos, audio, logos, branding, the Organize KAOS name, slogans, product names, character designs, website content, software, layouts, visual designs, training materials, presentations, and other proprietary or creative works.

Except as expressly provided in these Terms or another written agreement with Organize KAOS, nothing transfers ownership of, or grants any right, title, or interest in, any Organize KAOS Content or intellectual property.

You may not remove, alter, obscure, or bypass any copyright notice, trademark, watermark, proprietary marking, attribution, or other notice appearing on Organize KAOS Content.

You may not represent, claim, imply, or otherwise present Organize KAOS Content, in whole or in part, as your own or as the work of another individual or organization.

5. Acceptable Use

You agree to use our website and Offerings only for lawful purposes and in accordance with these Terms.

You may not use our website or Offerings in any manner that:

Violates any applicable law or regulation; infringes upon the rights of Organize KAOS or any third party; interferes with the operation, security, availability, or integrity of our website, systems, or Offerings; attempts to gain unauthorized access to accounts, systems, networks, or data; introduces malware, viruses, malicious code, or other harmful technologies; circumvents or attempts to circumvent security measures or technological protections; engages in fraudulent, deceptive, or misleading conduct; misrepresents your identity or authority; or otherwise uses our website or Offerings in a manner inconsistent with these Terms.

Organize KAOS may investigate suspected violations of these Terms and may suspend, restrict, or terminate access to any Offering if we reasonably believe these Terms have been violated.

6. Artificial Intelligence & Machine Learning

Unless expressly authorized in writing by Organize KAOS, you may not use any Organize KAOS Content or Digital Products to train, develop, improve, evaluate, benchmark, fine-tune, or operate any artificial intelligence, machine learning, large language model, automated decision-making system, dataset, or similar technology, whether existing now or developed in the future.

You may not upload, input, submit, scrape, extract, reproduce, distribute, or otherwise make Organize KAOS Content or Digital Products available for use by artificial intelligence platforms or similar technologies.

You may not use Organize KAOS Content or Digital Products to create derivative organizing systems, educational frameworks, competing methodologies, instructional materials, databases, commercial prompts, automated summaries intended for redistribution, or other products or services that substantially replicate or are derived from Organize KAOS intellectual property.

Nothing in this section prohibits an individual User from privately using generally available artificial intelligence tools to better understand or apply Organize KAOS Content for that User’s own personal, non-commercial use, provided such use does not redistribute Organize KAOS Content, create competing products or services, infringe upon Organize KAOS intellectual property rights, or otherwise violate these Terms.

Organize KAOS reserves all rights and remedies available under applicable law to protect its intellectual property from unauthorized use involving artificial intelligence or similar technologies.

7. Orders, Pricing & Payment

All pricing is subject to change without prior notice unless otherwise required by applicable law.

Organize KAOS may correct pricing errors, typographical errors, technical inaccuracies, promotional errors, or omissions and may cancel or refuse any affected order.

Submission of an order does not constitute acceptance. Organize KAOS may accept, reject, limit, cancel, or refuse any order, in whole or in part, for any lawful reason, including suspected fraud, payment issues, pricing errors, inventory limitations, misuse of promotional offers, or violations of these Terms.

Payment must be received through an approved payment method before an Offering is provided unless otherwise agreed in writing.

By providing payment information, you represent and warrant that you are authorized to use the selected payment method and authorize Organize KAOS and its payment processors to charge all applicable amounts, including taxes, shipping charges, subscription fees, and other applicable charges.

Organize KAOS may delay fulfillment, request additional verification, or refuse a transaction if fraudulent or unauthorized activity is reasonably suspected.

8. Offering-Specific Policies

Certain Offerings may be governed by additional agreements, licenses, policies, or purchase-specific terms, including, but not limited to, the Coaching Agreement, Digital Product License, membership terms, subscription terms, event policies, promotional offers, or other Offering-specific terms.

Offering-specific agreements and policies supplement these Terms and apply only to the applicable Offering.

If an Offering-specific agreement or policy conflicts with these Terms, the Offering-specific agreement or policy governs that Offering to the extent of the conflict.

Unless otherwise stated in writing or required by applicable law, all sales are subject to the agreements and policies applicable to the specific Offering.

Nothing in this section limits any rights or protections that cannot legally be waived under applicable law.

9. Educational Purposes

Organize KAOS provides educational Content, organizing methods, tools, frameworks, examples, and other resources to help Users develop organizing skills and create functional, maintainable systems.

All Content and Offerings are provided for educational and informational purposes only. They are intended to teach organizing concepts, decision-making frameworks, and practical organizing strategies, but are not intended to replace advice tailored to your individual circumstances.

You are solely responsible for determining how to apply Organize KAOS Content and Offerings within your home, workplace, business, or other environment.

10. No Professional Advice

Organize KAOS does not provide legal, financial, tax, accounting, medical, psychological, psychiatric, therapeutic, engineering, construction, safety, or other licensed professional advice.

All Content and Offerings are provided solely for educational and informational purposes. You should consult an appropriately qualified professional regarding matters requiring specialized knowledge or professional judgment.

You assume full responsibility for any decisions or actions taken in reliance on Organize KAOS Content or Offerings.

11. No Guarantee of Results

Every individual, home, workplace, business, routine, budget, and circumstance is different. As a result, Organize KAOS cannot guarantee any particular outcome from the use of its Content or Offerings.

Results depend upon many factors beyond the control of Organize KAOS, including individual participation, consistency, decision-making, available resources, physical environment, personal circumstances, and commitment.

To the fullest extent permitted by applicable law, all Offerings are provided “as is” and “as available,” without warranties of any kind except those that cannot legally be disclaimed.

12. Customer Responsibilities

You are solely responsible for your decisions, actions, implementation of Organize KAOS Content, and the results arising from your use of any Offering.

You are responsible for determining whether any organizing method, recommendation, or educational resource is appropriate for your individual circumstances and for maintaining a safe environment while applying Organize KAOS Content.

You are also responsible for providing accurate information when purchasing an Offering, creating an account, or otherwise interacting with Organize KAOS, and for maintaining the confidentiality of any account credentials under your control.

13. Commercial Use and Group Licensing

Unless expressly authorized in writing by Organize KAOS, all Offerings are licensed solely for the personal, non-commercial use of the licensed User.

A personal license does not permit the use of Organize KAOS Content or Offerings within businesses, educational institutions, nonprofit organizations, government agencies, professional organizing companies, coaching or consulting practices, workshops, memberships, subscription programs, employee training, client services, online communities, or other commercial or group settings.

Commercial, organizational, classroom, multi-user, or other group use requires a separate written license from Organize KAOS.

14. Testimonials

Organize KAOS may publish testimonials, reviews, success stories, photographs, or other customer experiences for informational or promotional purposes with the contributor’s permission, unless otherwise authorized by law.

Testimonials reflect the individual experiences and opinions of the contributor and are not guarantees or promises that other Users will achieve similar results.

Organize KAOS may edit testimonials for grammar, spelling, formatting, length, or clarity while preserving their intended meaning.

15. User Submissions

Organize KAOS welcomes feedback, questions, suggestions, testimonials, reviews, ideas, photographs, videos, and other voluntary submissions intended to improve our Offerings or customer experience.

Unless otherwise agreed in writing or prohibited by applicable law, any voluntary submission may be used, reproduced, modified, adapted, published, translated, distributed, incorporated into existing or future Offerings, or otherwise used for lawful business purposes without further notice, attribution, or compensation.

You represent and warrant that you have the necessary rights to submit any materials you provide and that your submission does not infringe upon the intellectual property, privacy, publicity, contractual, or other legal rights of any third party.

Nothing in this section prevents Organize KAOS from independently developing products, services, Content, or ideas that are similar to those contained in a User submission.

16. Copyright Infringement

Organize KAOS respects the intellectual property rights of others and expects Users to do the same.

If you believe that any Content or Offering infringes your copyright or other intellectual property rights, you may submit written notice identifying the allegedly infringing material, the rights claimed to have been infringed, your contact information, and sufficient information for Organize KAOS to investigate the claim.

Organize KAOS reserves all rights and remedies available under applicable law to investigate and pursue unauthorized use of its Content, intellectual property, or Offerings.

17. Suspension and Termination

Organize KAOS may suspend, restrict, terminate, or deny access to any Offering if we reasonably believe a User has violated these Terms, engaged in unlawful or fraudulent conduct, infringed upon intellectual property rights, attempted to circumvent security measures, or otherwise acted in a manner that may harm Organize KAOS, its Users, or third parties.

Termination or suspension does not affect any rights or obligations that, by their nature, survive termination, including intellectual property rights, payment obligations, indemnification, limitations of liability, dispute resolution, and other applicable provisions of these Terms.

Organize KAOS may discontinue any Offering at any time without creating an obligation to continue providing that Offering indefinitely.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Organize KAOS, LLC, together with its owners, members, managers, officers, employees, contractors, affiliates, licensors, service providers, successors, and assigns, shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising out of or relating to your access to or use of, or inability to access or use, our website, Content, or Offerings.

This limitation applies regardless of the legal theory asserted and includes claims relating to lost profits, lost revenue, business interruption, loss of business opportunities, loss of data, property damage, personal injury, emotional distress, or other economic or non-economic losses, even if Organize KAOS has been advised of the possibility of such damages.

If any portion of this limitation is determined to be unenforceable, the maximum aggregate liability of Organize KAOS shall not exceed the amount you paid to Organize KAOS for the specific Offering giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to the claim, to the fullest extent permitted by applicable law.

19. Indemnification

You agree to defend, indemnify, and hold harmless Organize KAOS, LLC, together with its owners, members, managers, officers, employees, contractors, affiliates, licensors, service providers, successors, and assigns, from and against any claims, demands, actions, proceedings, liabilities, damages, judgments, settlements, losses, fines, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms, misuse of any Offering, infringement of intellectual property rights, violation of applicable law, submission of unlawful or infringing materials, or any breach of your representations or warranties under these Terms.

Organize KAOS may assume the exclusive defense and control of any matter otherwise subject to indemnification, and you agree to cooperate in that defense.

20. Governing Law

These Terms and any dispute arising out of or relating to these Terms, our website, Content, or Offerings shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles.

Subject to any applicable dispute resolution requirements, any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in the State of Washington, and you consent to the jurisdiction and venue of those courts.

21. Dispute Resolution

Before initiating legal proceedings, you and Organize KAOS agree to make a good-faith effort to resolve any dispute through informal discussions.

If a dispute cannot be resolved informally, Organize KAOS may require mediation or binding arbitration where permitted by applicable law or pursuant to a separate written agreement.

Nothing in this section prevents Organize KAOS from seeking temporary restraining orders, preliminary injunctions, or other equitable relief to protect its Content, intellectual property, confidential information, or other legal rights.

22. Attorneys’ Fees

In any action or proceeding arising out of or relating to these Terms, the prevailing party shall be entitled to recover reasonable attorneys’ fees, court costs, expert witness fees, and other litigation expenses to the fullest extent permitted by applicable law.

23. Force Majeure

Organize KAOS shall not be liable for any delay, interruption, or failure to perform caused by events beyond its reasonable control, including acts of God, natural disasters, severe weather, fire, flood, pandemic, epidemic, war, terrorism, civil unrest, labor disputes, governmental actions, internet outages, power failures, cyberattacks, failures of third-party service providers, supply chain disruptions, transportation delays, equipment failures, or other unforeseen events beyond our reasonable control.

Any affected obligation shall be suspended only for the duration of the event and resume as soon as reasonably practicable.

24. Assignment

You may not assign, transfer, delegate, sublicense, or otherwise transfer your rights or obligations under these Terms without the prior written consent of Organize KAOS.

Organize KAOS may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, corporate restructuring, financing, succession, or other lawful business transaction.

25. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

26. Entire Agreement

These Terms, together with the Privacy Policy and any additional agreements or policies expressly incorporated by reference, constitute the entire agreement between you and Organize KAOS regarding your use of our website and Offerings and supersede all prior or contemporaneous communications, understandings, representations, or agreements relating to the same subject matter.

No waiver of any provision of these Terms shall be effective unless made in writing by an authorized representative of Organize KAOS. The failure of Organize KAOS to enforce any provision shall not constitute a waiver of that provision or any other right available under these Terms or applicable law.

27. Changes to These Terms

Organize KAOS may modify these Terms at any time. Unless otherwise stated, changes become effective when the revised Terms are posted or otherwise made available.

Your continued access to or use of our website or Offerings after the effective date of any revised Terms constitutes your acceptance of the updated Terms to the fullest extent permitted by applicable law.
